TERMS AND CONDITIONS OF USE – MOBILITY

Regulation of access and use of the field operations management platform.

These Terms and Conditions regulate the access and use of the mobile application and the field operations management platform (hereinafter, “the Application”), owned by Mobility[cite: 34, 35].

1. CONTRACTUAL RELATIONSHIP

By accessing or using the Application, the user agrees to be legally bound by these Terms[cite: 36, 37]. Mobility provides this tool for the optimization of promotion tasks, route management, and reporting at the point of sale[cite: 38].

2. DESCRIPTION OF THE SERVICE

The Application is an operational tool designed for[cite: 39, 40]:

  • Tracking and optimization of promoter routes[cite: 41].
  • Recording information at the point of sale (prices, inventories, brand presence)[cite: 42].
  • Generation of analytical reports based on information gathered in the field[cite: 43].

3. USE OF GEOLOCATION DATA

For the correct functioning of route management and visit verification, Mobility collects, uses, and shares precise location data[cite: 44, 45].

Background Location: The user acknowledges and accepts that the Application may collect location data even when the application is closed or not in use, provided the user is within their active work day, to allow for field operation tracking and route auditing[cite: 46].

4. OWNERSHIP OF INFORMATION

All information collected (price data, inventories, photographs, and reports) is the property of Mobility or its end clients[cite: 47, 48]. The user is prohibited from using this information for personal purposes or purposes unrelated to their professional work[cite: 49].

5. USER ACCOUNTS

Access is performed using credentials provided by the organization[cite: 50, 51]. The user is responsible for maintaining the confidentiality of their access data[cite: 52].

6. TECHNICAL AND HARDWARE REQUIREMENTS

The user’s device must have[cite: 53, 54]:

  • Location Sensors: Active and functional GPS capability[cite: 55].
  • Connectivity: Stable internet connection (mobile data or Wi-Fi)[cite: 56].
  • Photographic Camera: The equipment must have an integrated and functional camera for capturing evidence at the point of sale, shelf auditing, and inventory validation[cite: 57].

Mobility does not guarantee service availability in the event of hardware failure or network coverage deficiencies[cite: 58].

7. LIMITATION OF LIABILITY

Mobility shall not be liable for indirect, incidental, or consequential damages arising from the use of the Application, including loss of data or work activity interruptions due to technical failures beyond its direct control[cite: 59, 60].

8. MODIFICATIONS

Mobility reserves the right to modify these terms at any time[cite: 61, 62]. Continued use of the Application after such modifications will constitute acceptance of the new terms[cite: 63].
